Clear Futures is a partnership between Eastbourne and Lewes Councils and strategic delivery partners AECOM and Robertson. The strategic partnership offers services across the built environment, helping public sector bodies plan and deliver energy and sustainability projects and services.

The company responsible for your personal data on the Clear Futures website (https://clearfutures.co.uk/) is Robertson Group Limited (“Robertson”, “us”, “we” or “our”).  Robertson respects the value and privacy of everyone who visits this website. We will only collect and use personal data in ways that are described here and in a manner that is consistent with our obligations and your rights under the Data Protection Act 2018 and UK GDPR.

This Notice describes how we collect, use and share the information you provide to us and the information we collect in the course of our operations and our website.

1. Who we are

Robertson Group Limited is a private limited company registered in Scotland (Company No. SC060077). Our registered address is 10 Perimeter Road, Pinefield Industrial Estate, Elgin, Morayshire, IV30 6AE.

Robertson is the controller (for the purposes of the Data Protection Act 2018 and the UK GDPR) of your personal data that (1) you share with us via our website or otherwise been in contact with us or (2) we collect about you or that third parties share with us including, but not limited to, the methods outlined in Section 3 ‘How we collect your personal data’ below.

2. Key terms

When we refer to UK GDPR we are referring to the UK General Data Protection Regulation.

Personal information is information that can be used to, or in combination, to identify a specific individual, such as a name, address, telephone number, email address, etc., and also online identifiers and location data such as IP addresses and mobile device IDs.

A controller is someone who decides why personal data is to be collected and how it will be used and treated.

A processor is someone who processes data on behalf of a data controller.

We only collect information about you if we have a reason to do so including, but not limited to, the following:

  • When you contact us directly by letter, email or telephone including for such purposes as requesting information about products and services provided by Clear Futures or enquiring about a supply chain opportunity;
  • When you submit information using the ‘Contact us’ form on the website;

Depending on your use of our site and the information you provide, we may collect and use the following information about you:

Identity Data includes title, first name, middle name(s), last name, username or similar identifier, the company you work for (where relevant), your job status, your job title or position, sex, and geographic location (including postcode).

Contact Data includes residential and/or business address, email address, telephone numbers (business and/or personal including mobile phone and fax).

Voice Recordings which will include any information that you provide to us when you leave a voicemail message or when you telephone.

Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website. Usage Data includes information about how you use our website and services.

Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.

Aggregated data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature.   • Other members and divisions of the companies in Robertson Group where relevant to assist with the response to an enquiry or attend a meeting pre-contract;

  • Any other person who is authorised to act on your behalf;
  • Third party agents/suppliers or contractors to allow us to organise and run our operations, this may include, but is not limited to:

8. How we protect your personal information

We use appropriate technical and organisational measures to protect the personal data that we collect and process. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal data.

Our employees only process your personal data on our instructions and they respect the confidentiality of your data as do any companies acting as approved data processors for Robertson. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know.

9. How long we keep your personal information

We will only keep your personal data for as long as reasonably necessary to fulfil the purpose we collected it for, including satisfying any legal requirements, or for as long as we have your permission to keep it. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider:

  • the amount, nature and sensitivity of the personal data;
  • the potential risk of harm from unauthorised use or disclosure of your personal data;
  • the purposes for which we process your personal data;
  • whether we can achieve those purposes through other means; and

Your information is secured under UK data protection laws and will not be transferred to organisations beyond this area without your consent or if permitted by law.

The data that we collect from you will usually be stored inside the UK or the EEA.  However, in providing our services it may be necessary for us to share your personal data outside the UK or the EEA.

You can request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

You can request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

You can request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
